Terms Of Service

General info

Terms: The Artist (Myself) & The Client (You).
· The Client must be of legal age 18+.
· The Artist reserves the right to deny any commission for any reason without explanation.
· The Artist reserves the right to alter / change / remove any & all information from this T.O.S.
· The Client must agree that ALL References sent are in Good Faith & NOT AI.
· The Artist refuses AND & ALL NFT / AI (Artificial Intelligence) / Crypto. The Artist's work is prohibited to be used in any exploitive practices or training.

Terms Of Use

· Commissions are Personal Use Only.
    · (Commercial rights can be discussed & purchased separately.)
· The Client is prohibited to: sell, edit, distribute, alter, crop, trace, color-over, remove watermarks, manipulate, reproduce or use to train AI (Artificial Intelligence Technologies) to generate in any way. Nor shall The Client sub-license others to reproduce or use to train AI (Artificial Intelligence Technologies) to generate in any way, The Artist's Art or Commissions.
· The Client is allowed to only post the lower-res version of the Commission on their Social Media with full credit linking back to The Artist.
· The Client is prohibited from posting any high-res files to any platform, high-res files are for personal use only.

Intellectual Property Rights

· The Artist retains all Rights to the Artwork / Commission.
    · If Commissioned to illustrate an Original Character: The Client retains rights to their       Original Character, not the Artwork itself.
    · If Commissioned to create Fanart: The Company or Studio retains rights to the Character(s),       The Client has no rights to the Character(s) nor the Artwork itself.
· The Artist retains all rights to post on any of their Social Media, Galleries, Sell Prints, Merchandise and Publications, especially to Promote their Business.
· The Artist retains all rights to Live Stream / Record / Display these Commissions / Artwork.
    · Check Private Commission info under "Order & Delivery" below.

Deadlines & Revisions

· All deadlines must be decided & agreed upon by The Artist & The Client.
· Minimum deadline period varies on Commission Type & Complexity.
· The Artist cannot do less than 5 Business Days regardless of Commission Type.*
· The Client is allotted Revisions during the Thumbnail & Sketch stages.
· Revisions after the Thumbnail & Sketch stages will result in a fee.
    · Minor changes won't count as revisions!

Payment & Fees

· Commissions must be paid through PayPal or CashApp.
· All Commissions are to be paid 100% upfront in $USD.
· No work will begin until Payment is received.
· Applicable Commission Fees:
    · Private Commission Fee: 20%
    · Revision Fee: Revisions after Thumbnail & Sketch Approval will result in a ~10% fee.
    · Rush Fee: Depend on Commission Type & Deadline. Rush Fees are to be discussed after       Commission Form accepted.
    · (Depending on your Commission Type certain Rush Deadlines may be impossible.)
· Additional Characters/People/Props: May increase final prices.

Refunds

· Commissions are non-refundable.
· Exceptions to this:
    · The Artist can not start the Commission for whatever reason.
    · The Artist can not provide or finish the Commission for whatever reason.
· The Artist reserves the right to Cancel a Commission if The Client is unable to comply with or breaks any Terms Of Service. By breaking Terms of Service, The Client waives their right to a refund.

Will Do

· Yes: Dark Fantasy & Fantasy
· Yes: Portraits & Pinups
· Yes: Fan-Art & Original Characters
· Yes: Concept Art & Character Design
· Yes: Humans & Humanoids / Some Animals
· Yes: Nature & Landscapes
· Yes: Artistic Nudity & NSFW
· Yes: Gore / Horror / Dark Art / Violence: Blood, Cuts, Bruises, Guts, Etc.
    · (Note: The Artist reserves the right to decline any Commission deemed too inappropriate or      not in line with their vision or brand.)

Won't Do

· No: Graphic Design.
· No: Homophobic / Transphobic / Racist / Ablest / Hateful / Bestiality / Underage Art.
· No: Furry / Fursona. (Not in my wheelhouse or skill.)
· No: Art outside of The Artist's personal style such as: Anime / Cartoonism / Theme's that do not align with The Artist's forte.

Order & Delivery

· Fill out the Commission Form: HERE
· This is where you'll select your Commission Type & Enter all your Commission details
including potential Deadlins , Privacy Requirements, Etc.
· Delivery (What You Get:
    · Beautifully & carefully crafted Artwork.
    · Top Quality Customer Service & Support / Guidance & Work Flow dedicated to making        The Client's Commission PERFECT!.
    · Daily / Weekly / Monthly W.I.P's & Updates.
    · A High-Res (personal use only) copy of your Commission & Low-Res Glazed version for Social       Media sharing.

Final Disclaimer

· By submitting a Commission Form you hereby Agree & Understand all Terms in this T.O.S.
· Breaking this Terms Of Service (T.O.S) will result in being Blacklisted from The Artist's Services.
